1. About Remote Photoshoots
Remote Photoshoots provides professionally directed remote photography and image-creation services, including professional headshots, environmental headshots, personal branding portraits, corporate and team headshots, appearance modifications, product photography, and other related creative services.
Remote Photoshoots uses professional photography knowledge, creative direction, image-editing tools, and AI-assisted imaging technology as part of the creative process.
AI is used as a production tool. Each commissioned project is creatively directed and reviewed by Remote Photoshoots.
2. Eligibility and Age Requirements
You must be at least 18 years old to purchase or use Remote Photoshoots services.
Remote Photoshoots does not accept portrait orders involving individuals under 18 and does not accept photographs of minors as reference images for commissioned portrait services.
By placing an order or submitting photographs, you represent and warrant that:
You are at least 18 years old.
Every person depicted in photographs submitted for portrait services is at least 18 years old.
You are legally able to enter into these Terms.
Remote Photoshoots may cancel or refuse an order if there is reason to believe that a submitted photograph depicts a minor.
3. Client Reference Photographs
To create your images, Remote Photoshoots may require you to submit photographs of yourself or another adult for whom you have lawful authority to provide photographs.
You represent and warrant that:
You are the person depicted in the submitted photographs, or you have lawful authority and permission to submit them.
Every person depicted is at least 18 years old.
You have the necessary rights to provide the photographs for the requested service.
Your submission does not violate another person's copyright, privacy, publicity, contractual, or other legal rights.
The photographs do not contain unlawful or prohibited content.
Remote Photoshoots may refuse photographs or requests that raise concerns regarding identity, consent, ownership, age, safety, legality, or authenticity.
4. Photographs Created From Your Likeness
Remote Photoshoots uses the photographs you provide as visual references for creating commissioned images.
AI-assisted imaging cannot guarantee mathematically exact reproduction of every facial or physical characteristic.
Differences may occur in details such as hair, facial features, skin texture, body proportions, clothing, jewelry, hands, backgrounds, lighting, accessories, or other visual elements.
Remote Photoshoots will make reasonable creative efforts to produce an image that reflects the client and the agreed creative direction, but exact duplication of a source photograph or physical appearance is not guaranteed.
5. Creative Direction
Remote Photoshoots retains professional creative discretion regarding lighting, composition, posing, expression, image selection, cropping, retouching, color, styling, and other artistic decisions unless a specific requirement has been agreed upon in advance.
Reference images, mood boards, example photographs, or visual inspiration supplied by a client are treated as creative references rather than instructions to create an exact duplicate.
Remote Photoshoots will not intentionally reproduce another photographer's copyrighted image as an exact copy.
6. Artificial Intelligence and Digital Image Creation
You acknowledge that certain Remote Photoshoots services involve AI-assisted image generation or modification.
AI-assisted systems may occasionally introduce visual inconsistencies or unexpected details.
Images are reviewed as part of the creative process, but no digital imaging system can guarantee that every minor element will be physically or photographically perfect.
The use of AI-assisted technology does not change the customized nature of the service.
7. Appearance Modifications
Where offered, clients may request modifications to features such as hairstyle, hair color, facial hair, clothing, makeup, age presentation, or other aspects of appearance.
Remote Photoshoots may decline any modification request at its discretion.
Appearance modifications are creative simulations and should not be interpreted as predictions, medical representations, cosmetic-surgery simulations, or guarantees of how a person would look following a real-world procedure or physical change.
8. Client Responsibilities
You are responsible for:
Providing accurate information.
Submitting clear and suitable reference photographs.
Ensuring all individuals depicted in portrait reference photographs are at least 18 years old.
Reviewing service descriptions before purchasing.
Communicating significant appearance preferences or restrictions before work begins.
Reviewing proofs carefully when proofs are included.
Responding to requests for information necessary to complete your order.
Ensuring that you have authority to submit all photographs, logos, trademarks, branding materials, or other content provided to Remote Photoshoots.
Remote Photoshoots is not responsible for delays caused by missing information, unusable photographs, delayed client responses, or incomplete submissions.
9. Proofs and Revisions
Some services may include proofs or revisions.
The number and type of revisions included depend on the service purchased.
Revisions are intended to correct or refine an existing creative direction.
A request that materially changes the original concept may be considered a new image or additional service and may require an additional fee.
Examples may include substantial changes to:
Hairstyle or hair color
Wardrobe
Pose
Background or location
Image concept
Body presentation
Makeup
Facial hair
Branding direction
Overall photographic style
Once a proof is approved, additional changes may require an additional fee.
10. Turnaround Times
Any estimated turnaround time shown on the website or communicated to a client is an estimate unless expressly stated otherwise.
Completion times may be affected by order volume, complexity, revisions, client response times, technical issues, or the need for additional reference materials.
Remote Photoshoots is not responsible for losses resulting from a client's failure to order sufficiently in advance of a deadline.
11. Final Image Delivery
Final images are delivered digitally.
Clients are responsible for downloading and safely storing their delivered files.
Remote Photoshoots does not guarantee indefinite storage of completed client files.
Image dimensions, cropping, resolution, and formatting may vary depending on the service purchased and intended use.
12. Printing
Unless a service specifically includes print preparation, images are primarily prepared for digital use.
Color, brightness, cropping, sharpness, and appearance may vary between screens, printers, print laboratories, and physical materials.
Remote Photoshoots is not responsible for printing results produced by third-party printers or laboratories.
13. Payments
Payment is required according to the price and payment terms displayed at checkout.
Prices may change at any time, but a price change will not affect an order that has already been purchased unless additional services are requested.
You are responsible for providing accurate billing information.
14. Refunds and Cancellations
Purchases are subject to the Remote Photoshoots Refund Policy.
Because services involve customized creative work and digital products, refunds may be limited after work has begun.
The Refund Policy is incorporated into these Terms by reference.
15. Ownership and Intellectual Property
To the extent that copyright or other intellectual property rights exist in a final image created by Remote Photoshoots, those rights remain with Remote Photoshoots unless otherwise agreed in writing.
Remote Photoshoots does not claim ownership of a client's likeness.
Remote Photoshoots also retains ownership of its underlying creative processes, workflows, prompts, production methods, templates, website materials, branding, graphics, service descriptions, written content, and other proprietary materials used to operate the business or create commissioned work.
Purchase of a service does not transfer ownership of those underlying methods, materials, or business assets.
16. Client License and Use of Final Images
Upon full payment and final delivery, the client receives a perpetual, worldwide, royalty-free license to use the final commissioned images for ordinary personal and commercial purposes.
Permitted uses include:
Websites
Social media
Professional networking profiles
Resumes
Business marketing
Advertising
Personal branding
Email signatures
Dating profiles
Internal company profiles
Presentations
Publications
Printed promotional materials
Press and media use
The client may reproduce, publish, display, crop, resize, format, and incorporate final images into other designs or materials.
The client may also authorize a designer, employer, publisher, printer, marketing agency, or other service provider to make reasonable edits necessary for the client's intended use.
Remote Photoshoots is not responsible for alterations made after final delivery.
A materially altered version of an image should not be represented as an unmodified image created or approved by Remote Photoshoots.
Clients may not resell final images as standalone stock photography, templates, downloadable image assets, image-generation training datasets, or other independent digital products unless Remote Photoshoots provides written permission.
17. Private Archival Copies
Remote Photoshoots may retain a private archival copy of final commissioned images for internal record keeping, quality control, documentation of completed work, dispute resolution, and a private professional archive.
Retention of a private archival copy does not give Remote Photoshoots permission to publicly display, publish, advertise, sell, license, distribute, or otherwise use the client's likeness or final images for promotional purposes.
18. Portfolio, Advertising, and Public Use
Remote Photoshoots will not publish a client's submitted reference photographs or finished images for advertising, website galleries, social media, portfolio use, promotional materials, or other public-facing purposes without the client's separate permission.
Permission for public portfolio or promotional use is separate from the client's purchase of services and is not required as a condition of receiving the service.
If a client later withdraws permission for future public use, Remote Photoshoots will make reasonable efforts to discontinue future use.
Removal from previously printed materials, archived publications, or third-party reposts may not always be possible.
19. Privacy and Reference Image Retention
Personal information and submitted photographs are handled in accordance with the Remote Photoshoots Privacy Policy.
Reference photographs are retained only as necessary to provide the service, resolve disputes, meet legal or security obligations, and follow any stated retention period.
For more information about how personal information and photographs are collected, used, stored, shared, retained, and deleted, please review the Remote Photoshoots Privacy Policy.
20. Corporate and Team Orders
For team or corporate orders, the purchaser represents that they have authority to place the order on behalf of the organization and to provide any company materials submitted.
Organizations are responsible for obtaining any necessary employee permissions or authorizations before submitting employee information or photographs.
Remote Photoshoots may request confirmation of authorization where appropriate.
All individuals whose portrait photographs are submitted for corporate or team orders must be at least 18 years old.
21. Logos, Trademarks, Uniforms, and Branded Materials
Clients may only request the inclusion of logos, trademarks, uniforms, signage, branded environments, or other protected materials when they have the right or authorization to use those materials.
Remote Photoshoots may decline requests involving intellectual property when ownership or authorization cannot reasonably be established.
The client does not obtain ownership of third-party trademarks, logos, copyrighted materials, fonts, or other protected elements merely because they appear in a final image.
22. Prohibited Uses
You may not use Remote Photoshoots to:
Impersonate another person.
Create deceptive identity documents.
Misrepresent your identity for fraudulent purposes.
Harass, exploit, defame, or deceive another person.
Violate another person's privacy or publicity rights.
Create unlawful or prohibited content.
Infringe copyrights, trademarks, or other intellectual property rights.
Submit photographs of another person without appropriate authorization.
Submit photographs of anyone under 18 for portrait services.
Create unauthorized celebrity or public-figure lookalikes.
Circumvent website security or interfere with the operation of the service.
Remote Photoshoots may refuse or cancel requests that reasonably appear to violate these restrictions.
23. Refusal of Service
Remote Photoshoots reserves the right to refuse, suspend, or discontinue a project when reasonably necessary because of unlawful activity, abusive conduct, safety concerns, fraudulent activity, intellectual property concerns, nonpayment, violation of these Terms, or requests outside the scope of the service.
Where appropriate, any refund will be determined according to the work already completed and the Refund Policy.
24. No Guarantee of Business or Professional Outcomes
Professional portraits can influence presentation and first impressions, but Remote Photoshoots does not guarantee employment, sales, bookings, followers, business opportunities, dating outcomes, professional advancement, or other results from the use of your images.
25. Third-Party Services
RemotePhotoshoots.com may rely on third-party services for website hosting, payments, forms, file delivery, analytics, communication, AI-assisted image creation, editing, or other functionality.
Remote Photoshoots is not responsible for interruptions, outages, security incidents, or errors caused solely by third-party services outside its reasonable control.
26. Limitation of Liability
To the fullest extent permitted by applicable law, Remote Photoshoots will not be liable for indirect, incidental, consequential, special, or punitive damages arising from the use of the website or services.
Where liability cannot legally be excluded, Remote Photoshoots' total liability relating to a purchased service will not exceed the amount paid for the specific service giving rise to the claim, except where applicable law requires otherwise.
Nothing in these Terms limits rights or remedies that cannot legally be waived.
27. Indemnification
To the extent permitted by law, you agree to be responsible for claims, losses, liabilities, damages, or expenses arising from materials you submit, your unlawful use of the services, your violation of these Terms, or your infringement of another person's rights.
28. Governing Law and Jurisdiction
These Terms & Conditions and any dispute, claim, or controversy arising out of or relating to Remote Photoshoots, RemotePhotoshoots.com, or the services provided through the website will be governed by the laws of the State of Washington, without regard to its conflict-of-law principles.
To the extent permitted by applicable law, you agree that any legal action or proceeding arising out of or relating to these Terms or the services will be brought exclusively in the state or federal courts located in or serving King County, Washington, and you consent to the personal jurisdiction of those courts.
Nothing in this section limits any consumer protection rights, statutory rights, or other legal protections that cannot lawfully be waived or restricted by agreement.
29. Changes to These Terms
Remote Photoshoots may update these Terms periodically.
The current version will be posted on this website with an updated revision date.
Changes will apply prospectively unless applicable law requires otherwise.
30. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
31. Entire Agreement
These Terms, together with the Refund Policy, Privacy Policy, applicable service descriptions, and any written terms specifically agreed to for your order, constitute the agreement between you and Remote Photoshoots regarding the services.
